On the Florida's Sellers Disclosure statement, Item 16a states that "the seller has no knowledge of any existing or threatened legal action affecting the property. We stated we did not know of any legal action affecting the property. The buyer has broken the contract on our house, stating they we did not disclose a legal action. Our house has Masonite siding on it, which settled a class action lawsuit in the state of Florida. Any home with Masonite siding that is damage will receive a settlement from Masonite until 2010. This lawsuit was settled about 3 years ago. It was int he news and in the papers. Currently our home does not have any damage. The buyers previewed the house twice before they put an offer in on the house, and the house has been inspected. All wood related items have been repaired, based on the home inspection. Were we at fault for not disclosing the Masonite lawsuit, we are currently fighting over the escrow money, but the buyer has threatened to sue us over not releasing the escrow money. |
