Seller's Lied on disclouser


Detroit, MI
Purchased 1920's colonial with newer finished basement. Basement walls leak, upon recent inspection noted they have been leaking...this was missed by the original inspection company and previous homeowner (who checked "NO" on disclosure for water in basement; additionally, primary residence for 1 year and homesteaded). We have lived in home for 3 months, the driest 3 months in years so this has just occured with recent rains. We have photos of water damage...carpet and dry wall ruined, sub-floor in basement bathroom ruined. What are our options? Can we sue previous owner for waterproofing of basement?

I guess I wanted to know more if we have a case to win if we sue the previous owner. Please advise.

You have a chance if you can prove that the basement was leaking and that the Sellers knew that the basement was leaking during their time of ownership.
