Served papers regarding commercial rent


What is the name of your state (only U.S. law)? Texas.
I went into contract for a commercial space in March 2008. My sales never exceeded my rent and overhead. I tried everything, running the entire restaurant myself. In early October,I realized I could not pay October rent. I started looking for qualified partners/subtenants to change the theme and aquire additional capital. The LL denied my most qualified opportunity, based on "Indian food does not fit the demographic".. I was subsequently locked out of the Space early December due to failure to pay rent. In January, they approached the person I had presented, and offered her the space, with the same concept. She denied since she thought this was dirty business, and we had become friends. I have asked them many times for additional options to continue business, with agreement to pay past due rent ona payment plan. All have been denied and I was served papers yesterday (on my birthday). What are our options? SHould we even hire an attorney? Worried the fee could go toward rent. Please help and advise. What can they do to us now?
