sewer lines on neighbor's land

We purchased a property in May, 2002. One month after close, we had a survey done before installing a fence for our dogs, which revealed that the property we were lead to believe was ours (by markers pointed out by the real estate agent) was 28 feet less. Sewer and water lines were installed 1 1/2 years ago and parts of the line were placed on the neighbor's property. We come to discover that there are no recorded easements regarding this, the neighbor informed us that the previous owner asked permission to place sewer/water lines on his property and he emphatically told her "NO". The previous owner didn't disclose any of this and since being confronted with the problem, she claims she never spoke to the neighbor regarding this, or was she aware that the lines are on the ajacent property.
Question 1 - Do we have any recourse regarding recovering the cost of moving the lines to our property from the previous owner(we have already received a letter form the neighbor's laywer informing us, He wants the lines moved off his land?
Question 2 - Do we have any claim against the real estate agency that acted as both sellers agent and buyers agent with 2 seperate real estate agents (including signed agreements) yet clearly misrepresented the property and did not act in our best interest?

**A: hire an attorney to respond to neighbor's attorney and to send a demand letter to the Seller and real estate brokerage company.

If finances don't permit obtaining an attorney, call the State Real Estate commission in Harrisburg at 717-783-3658, and they will be able to direct you.
