What is the name of your state?ny

in ny, are there "squatter's rights". we have lived and worked on a piece of family property for 16 years. we have paid all taxes, insurances, improvements and maintenance. mil/fil agreed to transfer property over to us. then the lawyer died and made no provisions in the event of his death. now fil has died and sisters have poa over mil. they want to get medicaid for mil. want to know what our options are. leaving the farm is not one as it has been in the family over 150 years!

do we have any rights at all? we have paid for everything, maintained everything and made substantial improvements here for 16 years. also , mil only owns half interest in this property. other half is owned by her brother. does that open up any avenues for us or him?

As I have ALREADY said, you have NO OPTIONS at this point. You have been a renter under law, regardless whether or not you've had a formal lease/rental contract and in spite of not paying rent.

The money you have spent on the property is now in lieu of rent. Or did you think living there 'free' gave you specific legal remedy?

The ONLY option you have is to either purchase the place or wait until MOM dies then go through probate and end up with your portion of mom's ownership.

If I remember right, squatter's rights only apply if ownership of the property in unknown or cannot be determined. And if the property owner is known, the property must be occupied without the owner's permission. Neither happened in this case, claims of squatter's rights do not apply.

**A: your reasoning is incorrect. Squatters rights do not apply period.
