tenent trying to steal land in Bankruptcy Court

Tenent claims our land on chapter 13 filing we have title but she is claiming forgery handwritting analys done and says that it is not forged by us but by someone elese or coppied help we know for fact she signed title herself and has been paying rent for four years help cant get anyone to look at evidence. help! help!

You need to hire a BK attorney who handles creditor claims & notify the BK court that the house is YOURS & she is only a renter. Attach a copy of the tax bills showing that the land has been in your name for years, & the leases showing that she has been your tenant for years. Then file a criminal complaint against her for forgery. You will probably have to sue her to quiet title to the property. Your title insurance may cover the costs.

We have submited title, taxes, sec deed, to the bankruptcy court and was told that there was nothing they could do. this person is 30,000 $ in dept and has credit cards that she is still using,all though inocent we are having to prove that we are because of the way she filed. The BK court dosent want to listen to us because she has nothing else. They want the property.she went and borrowed $$$ two days before filing BK, our funds have been eaten up by numerous atty and our financial sitution is getting worse with, loan,lawers, taxes, still to pay

Did you submit a certified title report directly to the BK Trustee? The Trustee has the power to vacate the BK petition for fraudulent filing. This is a Federal offense to purposely include fraudulent information in the BK petition.

We have submitted everything and she is still getting away with it all they have to do is check her credit report to see that she is commiting fraud that way let alone with our property.Still no one will make a move because they want the property as sec. She has not had to prove anything in the claims that she has made. On the other hand we have proven that we own it.No one wants to listen.

I am not convinced that you did everything that I have suggested and/or a BK or real estate attorney would have done on your behalf because the scenario does not seem correct.

Regardless, please post your question on the Bankruptcy Law Bulletin Board for additional advice from others in this BK field.

Tell me about it dosnt seem real to us either. Between all the attornys they are dumbfounded to.All we need is to have a Judge look at all the evidence that we have and then maybe he can order the BK court to dismiss her claim.The justice system is not for the inocent.

You need to file a complaint in Federal Court against the BK Trustee.
