I own a unit in a Texas Townhome complex (NOT a condominium).
At our annual owners meeting we voted to stop doing several things that are listed in our document (Declaration and Covenants) as things that the association is supposed to be doing (namely maintaining a community TV antenna and billing for insurance payments in the monthly fee,-they will now be sent as a separate bill to owners).
Our attorney was present and she said that since these items were made obsolete by recent changes in state law, we did NOT need to or want to bother to change the document (by the process perscribed in the document) as this would be "too expensive" a thing to do. The major expense of course is her fee!
I was under the impression that the association documents (Declaration and Covenants) need to accurately represent how the association is run. If it does not, isn't this false advertising at least??? Thanks for your advice!!
