Tree on property fell onto neighboring house. Lawsuit?What is the name of your state? Washington My mom owns a second house that she is renting out. There is a tree on that property. The wind blew it and it fell over onto the neighboring house. Can they sue my mom? |

| Yes. Your mom owns the property and hence owns the tree. Now ask the question you really want answered.

| Anyone can file suit against anyone but the question is do they have a case? Was this tree rotting in anyway? If so they could get damages. Pure and simple "acts of god" are just that and no one is to blame. |

| I agree with lcannister. Your mom would not be responsible (to blame) if the tree was blown on your neighbor's house by wind. She might be responsible if the tree was dying/decayed & she knew it but took no action to remedy the situation. The homeowner of the house the tree fell on should report this to his homeowner ins. co. Anyone can sue anyone (as lcannister indicated) but that does not mean they will win the case.
