We recently entered into a contract with a logging company to clear trees (mostly pine) on OUR land to improve our view (view cut). In return for the work, the logging company kept all proceeds of timber sales. After the operation was finished, our neighbors hired a survey team which found that the loggers had cut about 10 trees on their land, and they intend to sue.
We were concerned at the outset about this happening and had provided the logging company with a copy of our land deed. Additionally, the logging company (they say) had acquired a map from our town clerk and assured us that no trees were cut on our neighbors land.
We at no time instructed the logging company to remove any trees that were not on our land.
What are our legal responsibilities in this matter? Can you suggest an appropriate course of action?
