trees gone


What is the name of your state? Texas I have owned 2 lots in a beautifully wooded area for 30 years. Yesterday drove there to discover they had been totally cleared - downed trees stacked on the lots -- by a new owner who had purchased the 4 lots adjacent and has been working for 6 months clearing in preparetion for living there. It seems they purchased by contract for deed without survey and seemingly think they purchased my lots in the deal. They do not live on the property, but told another neighbor they plan to do so. I have tracked down their name and address. I think I would like for them to pay for every tree, the replanting of the property and additional for all these problems and what really cannot be replaced in my life time. I have the feeling they will not be able to pay and since previously in my life wasted money on a useless "paper only lien" want to know how I can actually achieve recoupment here. Additionally, the person they purchased from is well known in the area for making sales of this type without survey. Can he be included in any legal way. Thank you.

**A: call the police right away and file a report. Then hire an attorney to sue this person and lien their property.

Thank you. Do you think I can include the guy who sold the property in the lawsuite?

OK - guess you made the point, the buyer did not get a survey...the problem is their's not the seller's. Thanks, I posted the No Trespassing signs today and visited with the sheriff. Am sending a certified letter with our requirements today.

Wow.. I really feel for you. Lot's of people don't get surveys, but if I were clearing lots, I would be sure to get one first.

**A: every Buyer should order a boundary survey and every Seller should make sure that a survey is completed before closing.
