What is the name of your state? Oregon Been living on our property of 30 years with a fifty foot easement running through that the neighbour (who moved in 11 years ago) behind us uses. He contends that he pays taxes on this easement and he owns it. The trees we planted 30 years ago are on this easement, but do not enroach on the road itself. He wants us to cut them down. Our Deed(circa 1969) says that this is " a non-exclusive easement for access".
This easement runs through our land, Is it true that he owns the easement? These trees were there and never presented a problem during the past 10 years after he purchased it, can he actually cut them down with out penalty?

**A: if you own the land then you should be paying the taxes on said real property. The neighbor is supposed to be the beneficiary of the eaement and not the land owner. Do the research and get back to us as to who actually owns the land that the trees are on and who pays the real property taxes.
