Trimming neighbors trees

What is the name of your state? CA
Our neighbor has a tree whose trunk is in their yard, but 80 percent of the tree overhangs our yard and extends approx 60 feet above our property. Some branches are so low they are touching our jacuzzi. We are unable to use the jacuzzi because of safety concerns and cannot allow our children to play in the backyard for the same reason. The tree has also started damaging the fence we share with this neighbor, uplifting parts of it. Question: If we trim what hangs over our yard back and this damages the tree or kills it, can the owner of the tree sue us? We have tried negotiating the removal of the tree, offering to pay 1/2 the cost of removal and the owner will not respond.

**A: yes, so did you get estimates from licensed tree trimmers?

We have tried negotiating the removal of the tree, offering to pay 1/2 the cost of removal and the owner will not respond.
**A: sue the neighbor in small claims court and force a response or get a default judgement in your favor.
