Two faced agent I co-listed a house with my boss. He sent over the initial listing agreement to the seller and then called me to tell me to take over. I informed the potential buyer that the draperies and the chandeliers in the home were not included. To my surprise my boss had not asked the sellers what was excluded..so nothing was on paper. I had asked them and that is why I had informed the buyer verbally. They acknowledged my verbal exclusion of these items. Last week I received a fax stating that they (the buyer) expected that these items be included in the sale (escrow due to close in three weeks) as nothing was noted "on paper", that they weren't included. In the same fax they acknowledged my verbal agreement but said it wasn't enough !!
Is it enough to give a verbal exclusion??
What recourse do I have??
