Undivided Estate

my question is, we have a family estate of undivided property and we need to have it divided up before too many heirs get involved. we have had it divided, surveyed, and all have agreed to have it done but 1. out of 19 members, 18 have signed the petition deed. is there a way that this can be settled? this one individual is in california, and has no intention of ever coming to this property. but for spite they won't sign; what now?? it seems there would be a way to force this one person to accept this division!

**A: yes, there is a way to force this one and last owner. Sue him/her in a partition action.
