My Dad & his 2 brothers had a 3-way interest in a piece of property. It was put into a Trust by brother #3 with his attorney as trustee for the benefit of all 3 (documented). Brother #3 died. After his death, all but one piece was sold out of the trust and the proceeds split. We wanted to sell the last piece and just found out that the family of #3 sold the last piece 9 years ago and never split the proceeds. Also, the sale was made out of another trust, their family trust. No deed has been filed to move the property from trust 1 to trust 2.

What is this type of theft called, what type of attorney would handle the suit, and what type of compensation are brothers 1 & 2 entitled to seek?

Thanks.
