I live in Maryland and my balcony is very unsafe to use. Wooden safety rails have rotted away and the the same for the decking. I live in a Condo and I have asked the HOA to repair this situation. They said that they where in the process of getting a loan to repair all of the condos that need repairing. The loan did not go through. And they say that they will not repair my balcony. Can I withold my condo fee and pay for the repairs myself and resume paying the condo fee once my balcony is repaired?
