valuation of property taken via eminate domain

What is the name of your state? Pa I know of a township that is tring to take a 40 ac parcel of ground thru eminate domain. The owner does not want to sell. The Township has escrowed money for the owner and is in the process of having to court settle this matter. Now the question....The valuation of the property is the fair market value of the land on the day that the taking took place. The value of this property is dependant on the number of homes that can be legally built on the property . The township thru its zoning ordance has tried to make it hard to devolop in the entire area. It has come to light that the zoning code is in violation of the state constitution after the state supreme court ruled that a similar township with a similar ordance is invallid.Thus the township has advertised that it will amend the ordance to make it comply with the state constitution. Does this mean that this parcel does not have a valid ordance limiting the number of houses per acre that can be built in effect at the time of the taking? If so, the this property would have emence value for lots prices for homes in this area are at about $100000 per lot. The faulty ordinace limited the entire property to 8 homes or lots.
