Washington State Easements


What is the name of your state? Washington
What is the time required to establish prescriptive easements?
For 7 years I (and the previous land owners) have used a private dirt road to access the driveway in our back yard. No objections from owner. Several homes must use this road to access their property. Now the land is to be sold. The new owner wants to build a 6ft. fence along the road without gates. I will no longer be able to access my own backyard. HELP!!!

your best bet is to sit down with a attorney and see what is needed now to to continue to use the access (and go talk with the others who were using that as access as well because If they were using it as well they should share in legal cost or they risk seeing fence or gate blocking them further up the line too )

Most of the others will not be affected. They live on the culdesac behind me & can cont to use the road whether it is fenced or not. Mine is the only property that will be blocked by the fence. I am a single mother of 4 & cannot really afford an attorney. Can anyone tell me what the time frame is for prescriptive easement in Wash. If I thought I had a chance in court I would spring for the Atty. I don't want to spend the money if it's a lost cause.

As I have just had to learn the time frame here in washington, I can inform you that prescriptive easements require 10 years to be valid.
