Water Runoff?


What is the name of your state? PA

I currently own a house with a underground pipe coming onto my property from the road water runoff of the neighbors. There is no easement or ROW agreements on my or my neighbors deed. The runoff was creating a ditch thru my property around 3' deep. During reconstruction of the house I ask for the township to help me put a pipe in to the back of my property to the stream. They said its my responsiblity. I currently put a pipe in and now the township wants it removed because its undersized. Before I did this my neighbor was getting water in her basement....since I put the pipe in and keep the water on my property. My question is...What right does the township have to remove that pipe? (they said if I do not remove it they are going to tear it out!) If I solved the problem and did not create another..can I keep it the way it is since it's "my property" and there is no agreements? What right does the township have to discharge water onto private property?

**A: the township has the right to tell you to do that. But there is no right of a private landowner to discharge water from his property onto yours.
