| we purchased our home from my mother in law--we recently obtained a loan from the bank to pay her off--so they bank now holds our mortagage. she lives in a mobile home located beside our home on our property...she has lifetime usage of the mobile home and lifetime usage of teh property--even though we own it----recently her attorney wants to draw up a "deed construction" for her regarding the mobile home. what is that and why would it be necessary? how or would this affect my husband and i and our ownership of the property> thanks so much |

It appears that mother already has a "life estate" interest in the property. |

| Is her lifetime usage for her entire life, or just as long as you own the property? Either way, the agreement should be recorded. If she has a true life estate, you won't be able to sell the property until she dies, cause no one will want to live with mom across the driveway. You might draw up the contract to say she gets to live on your property even if you move -- she gets to move with you. This would limit your future homes to places that allow mother-in-law trailors. ------------------ This is not legal advice and you are not my client.
