What are my rights? How to protect myself


What is the name of your state? New York. My "father" Bob is an alcoholic, disabled, doesn't work. I have taken care of him for the past 15 years without much, if any, help from 2 1/2 other sisters. I have had my name on the deed and have been actually living on the property for two years and have all utilities in my name, even though I live in a camper in the front field because the filth in the house was to much for myself and husband to keep up with. The drinking, passing out, blood, vomit, feces everywhere when I would wake up in the morning to get ready for college, is too horrible to horrible to describe, that is why my husband and I video taped him.
My question is, how can I protect my property from his stupidity? Can the government take it away (he has life use)? I caught hunters (I have livestock and dogs!) on the land (32 acres) the other morning - it was neighbor woman with her kid. I confronted them and she had a signed piece of paper by Bob stating if anything happens on property that they are not at fault. My husband flipped and went to ask Bob what he was thinking, and Bob had no idea what was going on. Drunk as hell. Every day. Liters of Vodka. I don't have $8000 to get him declared incompetant. I am Power of Attorney if I could figure out how to get him to sign it. He set that up, he just won't sign it, so what was the point of me paying for the thing? How do I protect myself, my property that I have taken care of for over 30 years? We don't want to sell the property, but my sister has her name on the deed also. I just want to be secure for once in my life. We catch his friends writing out checks for more than he agreed to also. How do I protect myself from my ignorant sister as well? If it comes down to having to sell the place, how do I get back everything I have put in? All the labor and aggrevation? As you can see, I am really flustered and scared of losing my home because of other peoples ignorance. I have had enough taken from me over the years and am trying to go down every avenue that is available to me before I have to give up. In all honesty the situation you describe is a perfect case for the other sibs to say you took advantage with the deeds etc. If he is as drunk and menatally disable as you describe then he had no business making decisions and signing things that were presented to him in a stupor.

The answer to the question about the govt taking it depends on what I describe above and how they would view the transfers.

Might want to consult an Atty versed in estates and real estate. If he signed that POA now it would mean little if anyone want to come forth and use the information you present here as the reason he was/is not capable of making such a decision!
