What is the name of your state (only U.S. law)? indiana

I live in an established 100+ year old neighborhood in New Albany Indiana that has NO HOA. NO deed restrictions to speak of. Single family homes with some rentals and no common spaces to mention.

Some of my neighbors are looking to start a "neighborhood association" to "beautify" the neighborhood. By-laws, officers and all.

There has been no vote by homeowners or any polling/sureying done to establish a legitimate need or a willingness for homeowners to participate in such an organization.

They have notified the neighborhood through a flyer of their intent to start such an organization, adopt by-laws and elect officers. No mention of dues has surfaced as of yet.

1) Will the mere formation of such an organization give it legitimate enforcement and peanlty powers?

If a HOA is disclosed in your deed, then yes. If not, then no, it will only be effective on those who opt-in.
