Who owns the tree?


What is the name of your state? South Carolina

I am in the process of buying a house in SC. On the property is a very large dead tree. The inspector I hired says the tree must come down. The current owner says the tree belongs to the neighbor.

I had a survey done and the surveyor says the tree is on the property line.

Surly, the tree must belong to someone - can it be a 50% on my property and 50% on the neighbors property? Who has ownership (and thus liability should it fall)?

Any thoughts?What is the name of your state?

Q: Any thoughts?

A: Yes. Either you pay for the tree to be cut down OR don't buy the place.

Maybe I worded my question badly?? My question is - who owns a tree that a surveyor says is on a lot line - can two lot owners actually own one tree? It would seem that either they own it, or I own it. Is there any law/ruling on this?

A: Of course. But do you have the time and the money to wait for a court ruling on this? Read my first answer.

Have you talked to the neighbor? What did they say? Ask the neighbor to go halves on the removal expense with you. Or, ask the current owner to remove the tree before the closing.
