Question

I reside in North Carolina. When my father gave my brother land that is located behind my sisters home and my home (my father/mother home) he included in my brother's deed that a 50ft right of way which runs along my home and takes a big chunk of land. It states in the deed that the right of way is transferred to whom ever owns the property. There are new owners now and they are considering putting in the right of way. There is another right of way at the back of the property that was once owned by my brother that was used for several years and is in wonderful condition. If the new owners proceed to put in the right of way across my land it will take out 100+ year old pecan tree, fruit trees, a large dog lot, garden space, flowers, bushes and my driveway. My pipes for my city water and water meter also sits on the projected right of way. What I would like to know is who has the responsibility of moving all the things I mentioned above? Will I lose them for good or does the new owner have to relocate such things as the dog lot, bushes, etc? What are my rights as the land owner? Thank you.

Sort of complicated so you need to have an attorney review everything.
