wrongfully built on land


What is the name of your state? Ohio
I was willed property, I have transferred deed. I had the land surveyed and the neighbor has half his house on my lot of land. What is my legal recourse.? I am sure the house has been there for at least 50 years.(it looks like it). I want to be on my land and I need all 5 lots.

In my state if a person openly uses land for a period of 25 years and pays the taxes without letting them become delinquent. They own it ! Check your county records to see when the house was built there. Is it on a slab foundation? If not possibly it was placed there < 25 years ago.

Tread lightly until you have all the facts.

Have you talked to the neighbor yet? What is his position on the matter?

And then even if you did, your response of "they own it" would not be correct.

It is quite possible that your neighbor has a survey showing that he owns the land. Overlapping surveys are not uncommon and can be a real bitch to straighten out. You need to check the courthouse for his title and see if any survey of his property is recorded. The surveyor should have checked so ask him first.
