Zoning for Animal Fostering


Conroe, Texas ....In Nov 08, I purchased my first home on 2 acres.....It is located in a rural area and all lots are around the same in size. I have only one neighbor that meets my property line. Over the last few months he has begun to foster animals (dogs). What began as a few has now increased to over 50. He has begun to receive aid from the Montgomery SPCA and constructed a fence and free standing kennels along our property line. I need to know if there are limits and what zoning might effect this from continuing as it is becoming a HUGE nusicance. The purpose of my move was for peace, and that is definately not what I have accquired. Thank you for any help.

I would offer the following suggestions.

1) Go to visit the local Zoning Official and ask him directly what the zoning for your area is.
2) If that is not suitable, then write them a letter detailing your concerns and request copies of the ordinances that cover this situation. Send this letter via Certified Mail with RRR & include in the body of the letter a request for a reply within say 10 business days.
3) Go to your local library, perhaps calling them to see if they have a copy of the local codes and Zoning Ordinances that cover your situation, review those and if you can determine what the status of this situation is, cite those regs in a [CM/RRR] letter to the Zoning /Code Enforcement people AND your Council-person and or Mayor all by CM/RRR.

Me, I would choose door #1 and then open Door #2. If I found the reception off-putting then I would try Door #3 and make sure to include the request for a reply with a deadline.]

I know notihg about Zoning in TX....you may find that there no rules if this area is Agriculutal enough or beyond local control.

OP's city does not have zoning.

In my state, shelter/foster kennels are regulated by a state agency. Essentially, the kennel must have a floor, outdoor areas must have full shade, kennel buildings must be temperature regulated, etc. OP needs to see if Texas has state rules.

Conroe is in Montgomery County. The population of the county is greater than 75,000. The Texas Health & Safety Code would apply in this situation. You may have to seek a local attorney to file for an injuntion § 823.007.
