Recently, the local schoolboard decided to target an
elementary school for replacement with a maintenance
facility.

The reason stated is that the school enrollment is declining
by 18% and they are looking to find a new home for a
maintenance facility. It will house trucks, supplies, equipment
the usual maintenance items.

This change must approve a residential R3 zoning to I
Industrial. It is going to be an EYESORE and reduce real
estate values significantly. There will be distractions like
fences, no trespassing signs, loud noises, etc.

What are legal grounds for rejecting their petiotio. The deed says they can change use after 15 years. Built 1956.

We have the usual, petitions from affected residents, local businesses, and parents of students opposition.

Any other legal grounds to reject variance?

Read your zoning ordinances. Those that oppose should chip in and hire an attorney to file action in opposition to the projected use and variance.
