abuse of handicap parking space


What is the name of your state? VT

next to the building I live in there is one handicapped space. Another resident is not handicapped-- she admitted as much. She does have a handicapped plate and uses the one spot. Is she breaking the law?

If she has a plaquard assigned to her, she is not breaking the law, as far as that goes.

Where she may have broken the law was how did she get the plaquard. If you believe she has ecieved a plaquard without reason, about the only thing you can do is call you states department of motor vehicles and ask them how to report this.

I wouldn't expect much to happen from this though but you can try.

No, she is not breaking the law. She may transport a handicapped person. She does not have to be handicapped herself.

Well if that were the case wouldn't she only be able to use the permitted spot while performing that duty?

Shay is correct on this point.

Haven't checked your states laws but in the 2 that I run around in, if the person who the plaquard is issued to is being transported in that vehicle, then it is allowable to park in a handicapped spot. If the the person the plaquard is issued to is not being transported in that vehicle at that time, it is illegal to use the plaquard to park in a handicapped spot.

You will have a hard time proving anything if it is being used illegally. If the spot is denied a person who does have permission and if the woman is illegally using the spot, then I would contact the police and the DMV to report such action. As before, not sure if it will get you anywhere but there isn't much else you can do UNLESS you are the handicapped person denied, then you may be able to push things a bit harder and further.

In my state, a placard alone does not entitle one to park legally in a handicap accessible space. You must possess both the placard and the medical authorization form. Mrs O_S keeps her form with her. One without the other when checked will result in a ticket.

If your neighbor does not have a qualifying disability yet continues to use the handicap space, she is violating the law. However, you are not likely to find anyone willing to cite her for the violation.

If there is a problem with access for other residents, consult with the property owner/landlord about designating additional handicap spaces. Also, a call to the state Human Rights commission might facilitate a better response than the DMV or LE.
