Question

Airport Parking Citation

Sorry, but this is going to be a little long.

My wife received a parking ticket for parking outside of the public parking lot at the Kona International Airport at Keahole. She parked next to the lot, off to the side of the road, but completely off the road, at least 50ft. from the nearest intersection. When she parked, the public lot, managed by AMPCO, had a clearly visible sign at the entrance to the lot that said "LOT FULL". The entrance was being attended to a Wackenhut security guard. Here are the problems that I have with the ticket:

1. I went to talk to the security guard at the lot entrance to ask him what people were supposed to do if the lot was full, and the answer I got was "I don't know". I got the same answer when I asked if there was anywhere else that the public could park, and was directed to find a security officer (described as one who wears a blue shirt) at the airport.

2. When I found a security officer, I asked him about the ticket, and that's when I was informed that the lot was managed and operated by AMPCO. The security officer said that they were only responsible for issuing the tickets, and that no one from AMPCO infomed them of the status of the lot. He furthermore told me that there were several vehicles in the lot that had been abandoned, which I confirmed and found at least 3 AV's, and 3 vehicles that were double parked.

3. On the citation there is a section for the issuing officer to print their name and badge #. Both are blank, and there is only an illegible signature. When I asked the security officer if he could ID the signature, he was unable to, but stated that it had to be one of his co-workers.

4. According to the [URL=http://www.courts.state.hi.us/page_server/SelfHelp/Traffic/941BE75157051BAEA900A0279.html ]Hawaii State Judiciary[/URL] website, Box A is the fine to be paid within 15 days. Box B is the fine if paid after 15 days. On the citation Box A says $35, Box B says $0.

5. The location box on the citation incorrectly states "Upper Rd." There is no Upper Rd. at the airport. The name of the road is actually Keahole Airport Rd. Terminal Access.

My questions are primarily towards the citation itself. Could I get this dismissed for the incorrect location? What about the entries in Boxes A & B? Becuase of the lack of a printed name and badge #, would that be ground for dismissal even though it's not a police officer who issued the citation? What's the best way to fight this, sending in a written statement or going to court? Could I go after AMPCO for failing to properly maintain the lot?

Of course, any advice would be appreciated!
