ANNOYING alarm in neighbors SUV.


What is the name of your state (only U.S. law)? California

Heres my problem. I live in a Mobile home. In my park, I have a neighbor who has the PERSISTANT problem with the ANNOYING alarm coming on without ANY reason almost EVERY freakin DAY. Typically a couple times a day, when Im home. But of course sometime I may go a couple days without the stupid alarm going on. BUT this has been a PERSISTANT for the last 2 years. YES 2 YEARS! I complained to manager of park. She does NOT do anything about. She just tells me "I cannot prevent the SUV owner from arming the SUV". Surprisingly NO other neighbors do anything about it. What's up with you "neighbors" I think to myself. Well it seems NOBODY is doing anything about it.

Eventially, I decided that. I can do a little something about it. When I hear that ANNOYING alarm, I just going to drive my van to that SUV, and Ill immitate the SUV with my horn. But I am being sure to do this ONLY when that ANNOYING alarm comes on. So I can hope to pass the message there. Its cause right NOW. My temper has reached BREAKING POINT! I am FED UP.

My question is. WHAT CAN I DO ABOUT THIS. The only thing I can think of is calling the police. Or just file a complaint to police or something.

Call the police - each and every time it goes off. Be polite and respectful and let them know you have put up with it for years and just want it to stop.

Honking your own horn will do no good except get YOU a ticket for the noise.

Do you think that there really is a way to STOP this ANNOYING alarm all together?? Is this stoppable???

Yes. I thought you would say that, about honking my own horn. What happens If I parked my van in the parking NEAR (not at), where the SUV is. And on purposely press the PANIC button on my remote, to immitate the SUV, when I hear that SUV alarm?

You can call the police and ask to have the owner placed under private person's arrest for disturbing the peace ... not sure how far that will fly, but it might get the neighbor's attention. You might want to get a recording device and start documenting the times it goes off and for how long.

What does the neighbor say about it?

A cease and desist letter from an attorney with a reference to private nuisance may get their attention as well.

Have you spoken with your neighbors about it? Does it annoy them as much as it annoys you? Maybe you can get together and in a polite, diplomatic way ask the offender if the alarm could be adjusted.

Oh, and I'd suggest switching to decaf.

I'm a quiet kind of people. I really DONT associate with the nieghbers too much. I have talked to at least one neighber. They claim they don't hear it going on every "minute". But Ill tell you, this SUV is next to about a total of 4 homes! I CANT BELIEVE this annoying alarm has NOT stopped. Just yesterday. I heard it blaring 2 times while nappin.

There are three ways to deal with this:

1. Talk to the owner and ask him to turn the alarm off.

2. Do what Carl says.

3. Write a cease and decist letter yourself. Basically, it only needs to say that the alarm has disturbed the peace and deprived you from enjoyment of your home. Also say that if it continues, you will seek civil action. As Carl said, get a recorder and tape the noise. Stand next to the SUV and try to talk so there is some audio reference for how loud it is. Document the time and date of each offense. If it happens several times after the cease and decist letter, file a claim in civil court and sue him.

I'm assuming you have tried "1". Cops likely won't take you seriously with "2". So, "3" will very quickly get the owners attention.

The only real problem with a police/criminal solution is that the law requires the noise to be both "malicious" and "willful". After notification (usually by the police) that the noise is disturbing others, a court might agree that the actions of the neighbor are criminal.

There is also the possibility that your city opr county has an ordinance against annoying car alarms - many jurisdiction have those now. Unfortunately, since this is occurring in a private place (the mobile home park) these ordinances may not be applicable depending on how they are written. The vehicle code has a provision against car alarms that allows for an officer to tow such a car, but if the alarm has ceased by the time the officer arrives, there will be nothing much he can do with regards to moving the vehicle.

In any event, either action - or both - involving the police and/or the letter should get some attention. But it would still be in your interest to get a neighbor on board.

So you say. I CAN make a letter MYSELF? In other words. Make a note and put it in the mail box of SUV owner about this 2 yr old problem? I can almost be sure that cops wont take me seriously. I agree. And obviously either the other neighbors are AFRAID of telling the SUV owner, OR the SUV owner has little or NO respect for how we feel about the annoying alarm. Its one of those "young" type people, I not saying who cause all of you will start to get all offended. BUT it's true what person X are like

Whether the cops take you "seriously" or not, if you call, eventually someone will respond. if the SUV owner starts getting visited by the cops he might do something. Plus, the cops may eventually get tired of being called out on the problem and might encourage said SUV owner to disable or modify the car alarm.

It would be of great help if you had the neighbors or the park management on your side. Start talking to them ... be friendly and gregarious. If you keep to yourself, of course you won't get any backing. heck, for all you know they're muttering the same complaints under their breath that you are.

Well, you would want to send it certified mail. Or, even regular mail. The USPS frown upon somebody putting things in to mailboxes that they own/control unless they've gotten their cut
