Question

Any chance of beating this?


What is the name of your state? New York (Westchester County)

This past Tuesday evening I had parked my vehicle on the side of the street that prohibits parking between 8am-12pm on Thursdays for street-cleaning purposes.

On Thursday morning at about 5am (I leave for work at 530) I went to move my car, but it would not start. (It turned out to be a faulty starter).

Now at 5am there aren't many options, and since my office is currenty short-handed, I really couldn't consider missing even part of the day.

I left a note on the dashboard explaining my inability to move the car and left for work. When I returned, (as expected) I was issued a ticket.

Is this "beatable"? That is, does the law state that the fine shall be dismissed if there is a valid reason, does the reason not matter at all, or is it subject to individual discretion?

Well racer72, after reading your insightful reply, I must agree with you.


I mean, after walking the block-and-a-half to my car and deciding that I simply

did not feel like moving it that day, I walked back to my home, wrote a note, then

walked back again to the car so I could tape the note to the dashboard - how

incredibly lame of me to not realize that I could have saved so much time, effort,

and money by just moving the vehicle.


And as I look at the imaginary (fake?) receipt for $238 from the auto repair shop, I

have to believe that I must be the absolute king of the lamebrains for thinking

that I might be able to beat a ticket with such a poor “excuse”.

Well, what kind of answer were you expecting to get. It is your car, it is your responsibility.
You can try to fight the ticket. good luck.

Do you really think the judge is going to buy the "there are no tow trucks available at 5am" argument? As much as you didn't like it, racer's answer was the legally correct one. Might as well pay up.

To thepenster060: I didn't know what to expect, I'm new to this forum.
My car = My responsibility, 100%.

To You Are Guilty: I never said that there weren't any tow trucks available at 5 am - now that would be an excuse. If I have to pay up, I'll pay...I was just mulling over my options, and I suppose there aren't any. As for racer's "answer", its not that I didn't like it - it wasn't an answer at all, and I thought the sarcasm was unnecessary.

To racer72: Though your hostile & sophomoric replies are quite brief, they really say so much about you -- quite a shame.
