Authorized car with valid parking permit was being towed


What is the name of your state (only U.S. law)? CA

I have the parking sticker issued by the property management which authorized me to park my car at the dedicated parking space since 2008. My parking permit no is: 1178 (See attached receipt for reference). In the beginning, I placed the parking sticker on my car dashboard. I had received a courtesy notice from the management telling me that I should paste the parking sticker on the vehicle windshield where it should be visible. Since then, the parking sticker had been pasted on my vehicle windshield (outside) as directed by the property management and some other authorized vehicle owners do. I did not have any issue about that at all.
On March 21, 2009 Saturday at 11:20am, I saw my car was being towed away and tried to stop it. I showed the patrol personnel where the sticker was pasted on the windshield. Surprisingly, the parking sticker was missing however the print was still there. The patrol personnel denied my explanation and insisted to tow my car without proceeding with further investigation. I was not given any paperwork or legal document which describes the tow authorization. The patrol personnel was there, the towing personnel was there, but none of them could prove me the tow authorization in black and white. They told me they were just doing their job. I was given TWO options – a) Pay $80 on the spot to avoid my car being towed away or b) My car would be towed away to the towing facility. I took the option A - paid $80 in cash to prevent my car being towed away.
I am familiar with the residential parking rules and the patrol process. I met with the patrol personnel once awhile when they were on duty as well as some other residents within the parking space. I have been parking my car with permission at the dedicated parking space almost every day. I am positive that the sticker was removed maliciously over night. This is a serious offence and it should have been caught by the law enforcement officer. I have made a police report with San Jose Police Department. This problem exposes the weakness of the private parking rules and regulations, and incompetency of the parking management whereby every resident within the neighborhood could be the victim, and I believe I am not alone. In addition, survey on the neighborhood could be done to verify my parking behavior and routine.
I was not given any warning or notice at all before the towing was executed. I am totally the victim of this incident since I DID NOT DO ANYTHING WRONG. I have spent my valuable time to defend myself against misconduct and I have paid $80 to the towing company which I did not deserve at all.

Can anyone tell me what can I do about that?

Did you find out who authorized the tow? If not, that should be your first step. There have been MANY posts on this site about rogue towing in California, so you want to determine if this was one of those.

Some of your wording is ambiguous. What do you mean by:

Do some owners put their stick on the inside of the windshield, which frankly would make more sense? I don't understand why management would tell you to put it on the outside, where it could be removed by anyone.

I didn't see any receipt attached to your post. Are you up-to-date on your sticker?
