Bogus Parking Ticket in NYC?


What is the name of your state? New Jersey

I recently received a letter from the NYC Dept. of Finance Parking Violations Bureau stating that I now owe $125 for a double parking ticket I received in Manhattan in October. The only automobile information on the summons was my license plate number, which is correct. The problem is, I have never driven or parked my car in New York.

I called and found out that the ticket was written on an older BMW silver 4-door sedan. I drive a 2005 dark blue BMW X3 SUV. I sent a copy of my registration to dispute the ticket. I have since received an additional notice offering me a reduced ticket of $90.

My fear is that I found a news story that ABC in Boston did a year ago about exactly the same thing happening to drivers in Massachessetts. Apparently, all of them were found guilty and ordered to pay the fines regardless of what documentation they provided.

Have you heard about this and do you have any advice about how I might proceed?

p.s. I can't provide "proof" of my whereabouts because the ticket was written at 8am on a Saturday morning. I would have been home in bed!

Unfortunately, this kind of mistake is very common.

If you plan on driving in the state of New York ever again, my advice is to pay the $90.

Yes, it is wrong and irritating.

Read the section about fatal flaws. Pay particular note about which errors mean the ticket "must" be dismissed as opposed to "can". If you only have "can" errors on the ticket, $90 is the best you can hope for. If you have even one "must" error, go down there in person and bring a copy of the .pdf with you as your argument.
