Car Towed from Private Property


What is the name of your state (only U.S. law)? California

I parked in a handicap parking space in my apartment's parking garage on the 2nd floor where I live. I forgot to display my placard. The "violation notice" left on my car was written by our security co. who patrols our units. On the back it state that the vehicle is parked on private property subject to the control of the owner. There is a lot of other stuff about tow co right to remove vehicle, etc. My car was towed at 11;50pm I picked it up at 4:30 the next day and they charged me for 2 days storage it was only 17hrs that they had my car. About 3 week prior to this, the security guard told me that they dont ever tow cars from our apt complex, they will give a written warning. Well the same security officer is the one who wrote the violation and called the tow company. I'm upset because I had to pay $335 to get my car out. The handicap spot has a blue sign but does not have the sign stating section @#$#@@ code ___@$###@ like I see in the city. Is it a valid handicap spot? Renee

Yes.

And I would bet you would have a tizzy fit if someone without a handicap placard parked in that same spot and did not have a valid handicap placard.

The space has to be properly marked by the sign and by proper curb and ground markings as per CC 22511.8, and this space may not have been properly marked. In my experience, most private property spaces are NOT properly marked.

The tow by the property owners might have been unlawful if the property was not properly marked as required pursuant to CVC 22658.

You may need to look in to a few things.
