Cell phone ticket in CA


What is the name of your state (only U.S. law)? California

Is there any way to beat a cell phone ticket? The ticket seems to be properly written. I'm waiting for my first worker's comp check and can't afford $132 - please help!

Not in this economic environment ~ If don't talk on the phone when driving, or if you get a bluetooth, there is nothing to beat.

Well, IGB I'd think that if the dude had his phone hanging from his ear when the police man ID'd him, then I'd bet you the cop's donut that the particular elements necessary were present.

Are we talking about a fancy donut or just a regular one?

Either way, I double your donut and raise you a large coffee only to say you're probably right.

My point was that the only argument the OP raised in his post was that "The ticket seems to be properly written" as opposed to questioning his own actions that led to that end result.

No real effort to help the guy (assuming it's a male). If he's guilty, he's guilty. There is the possibility that he could go to court and the cop fails to show up. There is the wiser strategy of seeking a delay, say, by seeking 'discovery' or simply asking for a payment plan.

The guy got great advice. The most obvious way to keep this type of situation is to abstain. You are so darn busy trying to get out of things by using loopholes that you forget the obvious.

It is against the law to hold the phone to your face, so just don't do it. It is against the law to drink and drive, so just don't do it. I could go on and on but anyone with an ounce of common sense should get the drift.

When we decide to step outside that box ~ pay the damned piper. It is called an opportunity cost.

IGB, you and wireless should just get a room rather than hijack another thread. The OP came here for advice on how to deal with a cell phone ticket that has already been written.... he is NOT asking for advice on how to prevent getting one in the future. And furthermore, in my country, EVERYONE enjoys a presumption of innocence and deserves opportunity to mount a zealous defense in court. Those inconvenient things you guys call loopholes have a different name as well... they are called LAWS!!! The state can't expect to hold its citizens accountable for adhering to the law when they are in violation themselves. I know that's a tough concept for you two, but it's apparent that you are not here to help people in the first place.


OP,

Please give ALL the details surrounding your ticket. The cell phone law in CA is just stupid and filled with inconsistencies (i.e. loopholes). Maybe you can take advantage of one of these if we know exactly what happened.

It never ceases to amaze me. The OP comes for advice, and because that adivce is not what they want to hear, it is deemed useless.

You know Jarnold, you came here for advice and you got it. The fact that what I had to say did not please you doesn't bother me in the least. You engage in risky behaviour behind the wheel and it will cost you money. I'm not the one who will have to fork out my hard earned money because of pure stupidity

Some posters here will teach you how to get around the system. If at then end of the day that is what you want, then have at it buddy. Unfortunately our world is filled with characters like you and jimbo who look for loopholes instead of what is right.
