Double parking


What is the name of your state? NJ

I've been driving for a year now and this is my first ticket. Well it's not really a ticket.

This morning, I was dropping my lil sis off at school. There was no space to pull over so I just pulled over to the side of the standing cars and let her out. As I was about to drive away, a traffic cop stopped me. He wrote down my license plate and said I would receive a summons in the mail for "double parking while letting off children". I apologized and drove away.

That's it. No ticket, no nothing. Is this worth fighting?

The problem is, I am not sure if I did it. I've been looking through NJ law for the last hour and parking is defined as

""Parking" means the standing or waiting on a street, road or highway of a vehicle not actually engaged in receiving or discharging passengers or merchandise, unless in obedience to traffic regulations or traffic signs or signals."

I was discharging a passenger so I wasn't really double parking, but was it illegal anyway?

You found the definition of "Parking" but you did not find the definition of "Double Parking". In NYC, "Double Parking" has the same laws as "Standing".

What is the definition of "Standing" in your state?

Your real problem (insofar as asking for advice) is that you have no idea what you may have been cited for. When you receive the citation, come back here and post exactly what code section you are charged with violating.

I agree. OP was discharging a passenger in the driving lane, not the parking lane.

Thanks for the replies guys.

PrinceCharming: I could not find anything about double parking in nj state statues, but here is how standing is defined:

""Stopping or standing," when prohibited, means any cessation of movement of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal."

Zigner: Alright, I will wait until I get something for you guys to work with.

But until then, I have some questions. Sorry if they seems obvious, this is my first time.

If its just a standard double parking violation, will I be forced to go to court or can I just pay it online or something and get on with my life?

If I contest the charge in court and am found guilty of it anyway, will I have to pay extra, or just the original fine?

So if "Double Parking" has the laws of "Standing", then you are guilty; otherwise you are not guilty.

The fine only goes up if you don't pay on time. If the time for you has not com yet because you are contesting the violation, then the fine will not go up. However, in NYC the fine can go down with something similar to what's called "a plea bargain".

I am sure you can pay the fine via mail. I don't know if NJ has a shopping cart on their website. The only problem is that you have to wait for your ticket. If after a month, you don't get your ticket, call the DMV or MVA or whatever initials your state uses for the motor vehicles.
