Double Parking Ticket NYC


What is the name of your state (only U.S. law)? NY

In my neighborhood, there are alternate side parking regulations, stating no parking allowed Tuesdays and Fridays from 11:30 AM until 1:00 PM. The neighborhood police allow us to double park our vehicles across from where the street cleaning is taking place. I was inside the vehicle and moved the car as soon as my cell phone watch turned 1:00 PM, since people have been given tickets for alternate side parking violations at 12:59 PM.

That day, I do remember seeing an NYPD traffic officer across the street from me, but no ticket was ever issued or placed on my windshield while I was in the car nor after I left. I am aware of this ticket because of the late fee and notice sent in the mail. The only evidence I have is that it was issued at 1:01 PM meaning he/she wrote it before 1:01 PM and it has no VIN number (officers normally scan the VIN of the car when they are in proximity to it.)

would that be a valid argument?

also, completely unrelated to this ticket but related to double parking: is it legal in NYC to double park behind a vehicle that is about to leave its parking spot in order to park in the soon to be empty spot? One would have the signal on of course to let others know you will park there.

Just because some officers have looked away from the illegal double-parking doesn't mean that it was actually legal for you to do so, the cite is valid.
