Erroneous Handicapped Parking Ticket


What is the name of your state (only U.S. law)? NJ

Got a handicapped parking ticket for parking next to a handicapped space in North Bergen. I was actually parked in a legal spot and got the ticket on the last day of August at 9:30pm. Took photos of my car w/ ticket the next morning (when I found the ticket), showing it next to the handicapped space, but I'm pretty sure when I go to court they're just going to say I moved it and make me pay the fine. Any suggestions (that might actually help me not have to pay the ticket)?What is the name of your state (only U.S. law)?

just to be clear; you were not touching any of the lines surrounding the handicapped spot, including the cross hatch area, if present?

No. Parking is parallel parking on the street and the only ground markings are on the curb (blue curb). I'm clearly 1-2ft from where the blue curb and sign indicate the handicapped space begins. I've parked in this exact spot probably close to 100 times over the past year because its easier to park/pull out with the large handicapped space in front of the spot. Time on the ticket indicates it was dark outside, but there is relatively good street lighting. My only thoughts are that officer thought the sign indicating the start of the handicapped spot was indicating the end of the spot.

I would suspect you are right but honestly, I have never seen a parking spot where the sign was at the rear of the space.

I would research the requirements for handicap parking spaces and see how this one fits in.

If nothing else, it would seem worth taking the shot the officer did see the situation as you suggest. If so, I would be very sure to show where the sign is in relation to the curb markings. That may be the clincher for you.

We have two.

Not sure why, as they pre-date my administration, but we've also got them on the list for the sign department to change.
