Habitual Handicap Parker Gets Away With It???


What is the name of your state (only U.S. law)? MA

My sister just experienced this and it just doesn't sound right. She works at a building that houses 2 companies. It has 3 handicap spaces that are continually being parked in by people who are not handicapped and do not display any kind of plate or placard. She has a daughter who is handicapped, so she is sensitive to this. She doesn't know the people who are parking in the spots, they work in the other company in the building. She got fed up and posted a sign on the door one night reminding people that illegal handicap parking can be ticketed for up to $300. The next morning when she came in, the sign was down and someone was parked in one of the handicap spots. She called the local police and asked if it was illegal to park in a handicap spot at a private company parking lot. They said yes and asked her if the person was parked there now. She said yes and they asked for the address and said they'd be right over. She could see out her window and saw the cops ticket the car. While they were doing so, someone walked over and spoke to the officer, then went into the building. The cop left the ticket on the car and drove away. A short while later, the cop returned and went upstairs to the other company. He later came down and talked with a manager at my sister's company and told them that he was mistaken, it's not breaking a law to park in a handicap spot at a private company parking lot.

What's the applicable law here?

MGL 40.21. The cop was wrong. The car can be ticketed and towed, private property or not.

I'm willing to bet that there are regulations as to what constitutes a properly marked/signed spot. Perhaps the spot does not follow those guidelines...

Yep, all those are spelled out in the same statute.

Cool

I'll just add that the VAST majority of HC tickets we give are to people who have a current, valid permit but just forgot to put it up. Some of those people parking in those spots may well be legit.

Not legit...UPDATE


The building owner has since removed 2 of the 3 handicap spots, and the offender is no longer parking in the one remaining spot, so even though it looks like no one was ticketed, folks got the message. The parking lot is small enough that one handicap space meets the requirements of the statute. Thanks to all who responded...I'm new to this site and it is a great resource!
