Handicap Parking ViolationWhat is the name of your state? Lousiana Yesterday I received a Handicap Parking Violation in my parking complex. In the parking lot there are 2 spots, on the right there is a Handicap symbol with bright blue background and a posted Handicap Sign with Van Accessible. In the Middle there is a big box with diagonal white lines and on the left there is a crudely faded image of a white handicap symbol with no blue paint and no sign. My car was parked on the left with no sign and the crudely faded image. I cannot find any regulations on proper handicap signage for Louisiana and would like to contest this in court. Can someone please send me some advice on whether this can be reduced or thrown out do to improper labeling, Thanks. |

| Google "ADAAG specifications" §1742. Parking spaces for certain disabled persons A.(1) Each state agency and political subdivision having jurisdiction over street parking or a government facility and each owner or lessee of a public facility shall, in accordance with applicable zoning and building codes, provide and maintain a minimum number of specially designed and marked motor vehicle parking spaces for the exclusive use of persons whose vehicles are identified by license plates, hang tags, or special parking cards for the mobility impaired issued pursuant to R.S. 47:463.4 or 463.4.1. The mobility impaired parking spaces shall adhere to the ADAAG specifications ETA: Ooops, wait. Street parking...government facility...public facility...I'm not sure this applies to an apartment complex. I would just delete this altogether but you may have already read it, so I'll just add the caveat that you might want to double check the applicability of those specifications--or check back here, someone might contradict me. | If any1 else could advice, it would be appreciated while my car is parked in the spot you can not see any visible sign of a handicap spot nor can you barely make out the spot as being handicapped at night. I talked to my apartment manager about it and she has no idea what the spot is designated as. |

| What do ADA guidelines have to do with it? The guidelines tell the facilities what they have to do to accommodate the disabled. It doesn't say squat about the prosecution of those abusing those accommodations. The Louisiana Revised Statutes just say "clearly marked" not "compliant with all ADDAG standards" You can try arguing the "clearly marked" issue though. |
