Are handicapped spots first-come first-serve at public venues

What is the name of your state (only U.S. law)? Texas

A relative of mine has a handicapped parking placard. Apparently they have made the handicapped spots directly outside the entrance of our local private college's basketball arena into pay spaces. ie. Only people who pay extra for the spots can park in them instead of them being available on a first-come first-serve basis. It this legal?

Free handicapped parking is further away from the arena, across the drive in the main parking lot. There are golf carts that run through that area to pick people up and deliver them to the entrance. Sometimes my relative has had to wait a while for a golf cart to pick him up, and sometimes in inclement weather. It is also allowable to drive right up and drop disabled people off at the entrance.

I don't have a definitive answer for you.

I took a quick look through the TX statute and came away with the impression that government agencies may not charge a parking fee but there is nothing in the statutes that prohibits private property owners to do so. If something is not prohibited by law, it's legal.

You might want to take a closer look at the statutes:

Thanks for the response. I could not find anything on the internet that directly addressed the issue either. I think my best bet is to do as you suggested and contact the Governor's Committee on People with Disabilities if I want to pursue this further.
