HC Ticket on abandoned propertyIrvine, California parking for a constrution site is being provided on the adjacent property where the building is empty and not occupied (compete with overgrown shrubs and weeds). Unfortunately, the handicapped spaces for the building are still marked and striped although it seems that the contractor could have pulled the signs and painted out the spaces. Tickets were given to several vehicles for parking in these spaces. Since there is no business operating on the property and there are no parking requirement for this property, can a ticket be given for violating handicapped parking in this situation. thanks |

| The statute that specifies the requirements for handicapped parking stalls says nothing about an active business using the parking lot. The tickets are valid.

| Ditto what Racer wrote. Generally the only defense against these violations would be that the spaces were improperly marked. However, you can always go into the hearing with the administrative panel and effectively plead guilty with an explanation hoping that the board will decide that there was no need for the citation due to the situation. But, that's a long shot. Though, it might be your ONLY shot. - Carl
