Jail time for DMV violation?!?!


What is the name of your state? NJ

I recently threw a small firecracker out the window of my friends truck. Someone saw this and followed us and called the police. I was the passenger and was given a ticket for 'throwing objects from a motor vehicle'. The statute cited on the ticket is for a different violation 'placing injurious substances on the highway'. When I went to court, the prosecutor said, "this would be a $200 fine", yet when I stood before the judge he began talking about suspending my liscense for 5 years and throwing me in jail! How can that be? I told him I was unemployed and he gave me a week to come back to court with a job. Can he jail me for this violation? Should I change my plea to not guilty since the ticket says I was driving, shows the incident happening at another location, and describes the violation differently than the statute cited? I don't want to get locked up for something so stupid.

The statute cited was 39:4-63 but the description of the offense on the ticket would be 39:4-64.
