Mom

What is the name of your state? Illinois

I am trying to find legal definition. I received a ticket for parking
in a Handicap Space at my childs school. The issue I have is I was not
parked.

I arrived early to pick up my child for an afterschool appointment.
The pick up lanes were blocked by school busses. There are "no
stopping, no standing, no parking" signs everywhere. I pulled into
one of 6 open spots to allow my child to get into the car safely.
I never exited the car and the moter was running. A police car
pulled behind me and blocked and way to move (if I would have been
asked to I would have done so immediatly) I had called
the school and had my child pulled from class early and hes was exiting the school as the (very arrogant) officer was requesting my license.

My question is is this wrong? What is the definition of parking?
I was in the spot just a minute or so and would have moved if directed or
another car was demanding the spot. The officer was very curt and
negative.

Should I fight this $100 ticket ? Do I have grounds to stand on.
The school does not provide any other pickup lane than those blocked
by the buses.

This is the definition of parking: "...I pulled into one of 6 open spots to allow my child to get into the car safely. I never exited the car and the moter was running...."

In virtually all states, the definition of parking is going to include language similar to "parking, standing, or stopping". The laws are never (in my experience) written to say that it is okay as long as you leave when asked.

Sorry, but you're likely going to have to suck it up on this one.

And on that note, it is a common problem and we regularly issue such citations in my town as well. Double parking, stopping in the street, and illegal U-Turns are common in front of our schools, and we issue a lot of warnings, and a lot of tickets.
