My own Driveway

What is the name of your state? San Diego, California. Law CVC22500(f) I was parked in my own drive way, with only my rear bomper barly over the sidewalk. Also nieghbors Truck was completely over the sidewalk and almost in the road, and didn't get a ticket. My family has lived in the same house for years and never had this before. Also the nieghhood is full so there is no other parking left on the street, this is my only parking spot I have. It is only the rear bomper that was over about few inches.

What can I do about this? Is it posible to get out of this ticket?

Get a bigger driveway or a smaller car.

I found that when the house was built there was a law that said there must be 1 off street parking for each bedroom. my house 3 bedrooms and so must have three parking spots. So that makes 2 in the garage and one on the driveway. Also my family bought the house before the law came to be about parking over the sidewalk. Also car were long back then.

Could this be used as a way to get out of the ticket.

The sidewalk law has been in effect for many, many years ... I'm in my 40's and it has been in effect since I was a child.

You cannot obstruct the sidewalk. You can always beg and promise not to do it again, but if any part of the vehicle was over the sidewalk, you are technically guilty.

(f) On any portion of a sidewalk, or with the body of the vehicle extending over any portion of a sidewalk, except electric carts when authorized by local ordinance, as specified in Section 21114.5. Lights, mirrors, or devices that are required to be mounted upon a vehicle under this code may extend from the body of the vehicle over the sidewalk to a distance of not more than 10 inches.

And that is the problem... your vehicle was NOT completely within YOUR property and was extending onto the public property. That is why you were cited.

Not relevant. You were cited.

Completely RELEVANT. That is why you were cited.

Your options are:
1) Pay the fine, or
2) Go to court and present your defense.

See answer above.

Where did you 'find' this. Provide a link or reference to the EXACT statute or Code. Reason.... I think you are confused or mis-advised. It would be unusual for such a code in a RESIDENTIAL area.

No.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
