Non Registered car got towed - Plea 'guilty' ?What is the name of your state? New Jersey We have a car that we could not make payments on. Stopped paying. Called the bank to come and pick it up, they never did. The car is 2003 model in driving condition, however registration expired a few month ago so we did not drive it. The car was parked near our condo at our condo complex, in a spot designated as free. It got towed this morning, and a police ticket was left in out mailbox, with a non-mandatory court date, meaning we could plea guilty over the phone and pay a fine for a non registered car. We are not even sure if the police can tow a car from a free spot, even if the registration expired... ![]() Now, to the point: We don't want the car, we want the bank to repo it, or whatever. so what do we do? A. Pay the fine, pay the towing/storage and get it out, then contact the bank again? B. Pay the fine, but leave the car at the lot and let them auction it off? C. Tell the bank where it is, let them bail it out and take it? C. Go to court and tell the judge we don't want it? D. Anything else???? Money is very tight, we just want the least costly solution. | You still own the vehicle (your payments are likely not on the vehicle, but on a loan to purchase the vehicle). That means you are responsible for it. If the car is not registered, it should not be in an area viewable from a public roadway (this includes your driveway). If it's in an area that it can be towed, it can and, as you found out, will be legally towed. You are responsible for the citation, as well as any towing/storage fees of the vehicle.

| If I can't pay the towing/storage fees, does the towing company have the right to repo the car to cover their costs? |

Paying the storage feesI am a contracted towing company for many municipalities in NJ. This is the procedure for such a vehicle. If no one claims the vehicle within 15 days, I notify the police department. They will send the last registered owned a summons with mandatory court appearance for willful vehicle abandonment. (NJS 39:10-A-1) This carries a $500 fine + Towing and storage fees If you fail to appear or reply then they immediately suspend your license for up to 2 years + $500 fine + Towing and storage fees. (NJS 39:4-56.5) After you have been summons and sent a certified letter the vehicle title will be applied for through NJDMV. But applying for the title for auction doesn't clear you from possibly having your license suspended or fines. I would definately go to the local police department and talk with someone in traffic safety. Explain your story and see if they could advise you of your best decision. Hope this helps and good luck.
