NYC--Car Seizure Question


What is the name of your state? NYC

Can your car be seized for unpaid parking tickets while you're
in the vehicle?

Of course not. Much like the game of "tag", your vehicle is considered "home base". As long as any portion of your body is touching it (you don't need to physically be inside, even a hand on the hood will do), you are "safe" and they cannot take your vehicle. However, if the contact breaks, even momentarily, then the protection is lost.

New question -Intimidation Tactics


My daughter & i were in the car & 4-5 people (marshalls & otherwise)
surrounded us & blocked me from leaving by standing in front of the car,
and surrounding the vehicle with a tow truck & suv. They basically intimidated us out of the car. I didn't know my rights -that i didn't have to get out. It was on a dark, desolate street in manhattan (i actually live in the bronx) at midnight. My daughter is autistic & she was afraid because she thought they were taking us to jail. They left us stranded out there, thank god i had some money on me. Is there anything i can do about the manner in which they went about it?

If they commited any of the following acts, you may have a case:
  1. Threatened you with a baseball bat;
  2. Threatened you with a gun;
  3. Threatened you with lunch meat (head cheese excluded);
  4. Revealed their genetalia in a "swinging like an elephant trunk" fashion in the view of a minor;
  5. The use of any Polish jokes (must include punchline);
  6. Urination on any portion of your vehicle, (except in the tailpipe);
  7. Any request (verbal, written or skywritten), that you bring current your overdue account with the Parking Violations Bureau;
  8. Any request (verbal, written or musical) that you sleep with any employee of the Marshall's office in return for "favors";
  9. Any sexual use of a Slinky toy in view of a minor;
  10. The posting of any "Wanted" posters with your likeness (name and/or photo) on them; or
  11. Stating in earshot of other pedestrians that you must exit your vehicle because you failed to pay over $250 in outstanding parking tickets and/or don't deserve to be permitted to drive until you did so.


Have you paid the outstanding tickets, tow fees, impound fees and Marshall's fees yet?

Actually, they did say that. Once i asked who they were & what it was about, they told me they were marshalls, and were seizing the car because i had outstanding tickets, and there were people there (it happened in front of a catering hall). And nope, i haven't paid them yet. Since i have no real ties to that car i may not even bother, but i was interested in how legal the whole ambush was. Thanks for the advice.
