NYC No Standing Parking TicketWhat is the name of your state (only U.S. law)? NY On 8/30/2009 1pm I was driving my car in Flushing NY dropping off my mother on a no standing sign street. After I drop off my mother and ready to leave my wife noticed that there was a traffic police at the back writing a summon. At that point I drove away. I never received any parking ticket in the mail. Until today I went online and found out I do have a parking ticket under my license plate and they even charge me additional $10 penalty for overdue. What should I do? Can I still dispute because of dropping off my mother or I say I never rec'd a physical tcket? Any suggestion? The ticket description says: NO STANDING-DAY/TIME LIMITS Code 14. Thanks |

| NYS DMV - Driver's Manual - Chapter 7 "A NO STANDING sign means you may stop only temporarily to load or unload passengers." I suppose a lot depends on exactly what the circumstances are. It sounds like if you simply stopped the car, kissed mom on the cheek and she got out you'd be fine. I suppose that if you walked mom to the door you would be considered "parked" rather than "standing" which would certainly lead to a ticket. With the amount of time passed and the fact that it's late is it even worth fighting over at this point? It's just a parking ticket. |

| You would not get a parking ticket in the mail. People drive away on traffic agents while they are writing all the time thinking that gets them out of the ticket - it doesn't. The no standing would hinge on the amount of time you were stopped at the curb. Stopping to expeditiously pick up or drop off a passenger is permitted in a no standing zone. Stopping there for 2 or 3 minutes saying goodbye is not acceptable. Only you know how long you were stopped. Go online and view a copy of the original ticket. Unless there is a notation on it that says "drove away" or something similar, then you could at least fight it based on the fact that the registration check digit is not on the ticket - and it's required unless it was a "drive away". Unless the agent walked up to your windshield and got it off the registration sticker. |
