Parked in front of fire hydrant and towed

What is the name of your state? Utah

A little background. So, I got a parking ticket a few months back for parking along a street where the curb wasn't painted red. I get a ticket. I go in to contest it and the guy says the paint doesn't matter anymore, you only get fined if there is a sign. He cuts the fine in half and I go on my merry way.

Now, I park in front of my apartment building across the street in front of a fire hydrant. It's painted red, I've parked there before, I've seen other people park there before, and there is no sign. The hydrant is all rusty and gnarled, so I've never really worried about it. Well, today I got towed. I can't prove the guy told me the paint doesn't matter and that it's all by what the sign says, but do I have any hope in getting this overturned?

Of course you do. Hope lives everywhere. However, unless you can PROVE that the hydrant is no longer in use, you have ZERO chance of getting the ticket dismissed.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

How about if the hydrant is hidden? There is a telephone pole right beside it, and from the side you can't see the hydrant at all.

Too bad you parked IN FRONT of it

The point is that the fire department needs to use that hydrant in the interest of public safety. It is incumbent on you to inspect where you are parking to make sure there is not one there. A pole isn't going to obstruct the hydrant sufficiently to make a defense. I guarantee that the fittings on that hydrant are accessible and visible to the street or it would be useless to the fire department to have it there.

Your lucky there wasn't a fire. In addition to civil liability, I've seen fire departments due crude things to get access to obstructed hydrants.
