parking ticken for car that has been soldWhat is the name of your state? California On July 22 we traded in a 1993 GREEN Ford Taurus for $200. This car had accident damage, the transmission did not work right and had other problems. Although drivable, the dealer indicated it was slated to be wholesaled or junked. The dealer was going to fill out the release of liability the next day. On July 24 (I received the notice on August 8) the car may have received a citation for no display of tags. The ticket has a license plate number but the VIN is blank and the color is blue. It does indicate the correct make but there is no model name. I have contacted the dealer to get the completed paperwork to file an "initial review" with the Police Department. Hopefully this will take care of my problem but if it doesn't how can I prove that the car was not parked anywhere on that date. I have read other posts that indicate that mistaken color is not a significant error but other than the plate number and make there is no match to the car. In any case, the SELLER is required to file the release of liability with the DMV within FIVE calendar days. Never rely on the dealer or some other third party to take care of the paperwork that YOU are legally required to submit. You *may* be able to have the ticket dismissed based on the information that you did not own the car. You will not be able to have it dismissed due to any "errors" on the ticket (there were none)

I knew that the seller is required to file the liability release but there is something about spending all day at a dealer that caused reason to fly out the window. I asked about it but don't remember the answer the business office gave. Lesson Learned. Of course if I can't prove any of this I will pay the fine and curse my stupidity and the dealer. |

| People who are color blind cannot distiguish green from blue. What does "no display of tags" mean? It cannot refer to plates if the ticket had a license plate number (unless plates were stolen and/or not properly mounted)? Was registration or smog inspection expired or due to expire when you traded it? Was the dealer able to account for the car with plates still on it? It is not inconceivable that the plate number was in error. There have been plenty of posts here from people who received parking tickets with incorrect info, or people who received tickets for locations they were nowhere near. I received notice for a delinquent parking ticket from City of Chicago for a date when I was in Ohio, but they never told me location or vehicle description (got it dropped). |
